We all have a right to change our will at any time, so long as we have the mental capacity required to do so. This is a common scenario in individuals who require help staying in their own home who may wish to recognise the assistance they have been given by certain relatives, friends, or even paid carers.

However, once an individual has been diagnosed with an illness that affects their understanding, it becomes imperative that a mental capacity assessment is made at the time the will is signed.
