If the client has a diagnosis that might affect their understanding, there is the potential that they do not appreciate the implications of making the gift. This can therefore be legally challenged on the basis of a lack of mental capacity to make a gift.
We are able to make an assessment of the client's mental capacity to make a gift at the time the gift is made, thus providing the reassurance that the transaction has integrity.
